Terms of Service
These terms govern your use of the Diko mobile application and the marketing website at getdiko.com ("the Service"). By installing or using the Service you agree to these terms. If you don't agree, please don't use the Service.
1. The licence we grant you
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Diko on devices you own or control, for non-commercial personal study. You may add, edit, and delete decks and cards as you see fit.
On iOS, this licence is also subject to Apple's Licensed Application End-User License Agreement (the "Apple EULA"). Apple is not a party to these terms; this agreement is between you and us.
2. What you must not do
- Reverse-engineer, decompile, or disassemble the app beyond what applicable law allows.
- Use Diko to store or distribute content that is illegal, infringes third-party rights, or is intended to harass another person.
- Bypass or attempt to bypass any security or rate-limiting measure.
- Use Diko to violate the privacy or intellectual property rights of others.
3. Your content
You own the decks and cards you create. We do not claim any rights to your content. Because the MVP keeps content on your device, we do not store it; you are responsible for backing it up if you wish.
If you choose to enable a future sync feature, you grant us a non-exclusive licence to store and transmit your content for the sole purpose of providing that feature to you. The licence ends when you stop using the feature or delete the content.
4. Seed decks & localised content
Diko ships with a small set of sample decks (Spanish, Catalan, French, Russian, English, Product Thinking) translated into six interface languages. These are provided as study material, not as authoritative reference works. We do not warrant the accuracy of every translation or definition, and we welcome corrections at hello@getdiko.com.
5. Subscriptions, in-app purchases, refunds
The MVP is free of charge. If we introduce paid features in a future build, the price, billing cadence, and refund policy will be disclosed at the point of purchase, and refunds will be handled by the relevant app store under their standard refund policy.
6. Updates
We may update the app over the air via Expo Updates, or through the App Store / Google Play. By using the app you consent to these updates. Material changes that affect privacy or the price of paid features will require explicit acceptance.
7. Termination
You can terminate this agreement at any time by uninstalling the app. We can terminate or restrict your access if you breach these terms; we will give reasonable notice unless the breach is severe.
8. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. Diko helps you study; it does not guarantee a particular learning outcome, exam result, or fluency level.
9. Limitation of liability
To the maximum extent permitted by applicable law, our total liability arising from or relating to the Service is limited to the amount you have paid us in the previous twelve months (which is zero for the free MVP). We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, lost profits, or business interruption.
10. Governing law
These terms are governed by the laws of France, without regard to its conflict-of-laws provisions. Disputes that cannot be resolved informally will be resolved before the competent French courts, except where mandatory consumer-protection law of your country of residence requires otherwise.
11. Apple-specific terms
For iOS users:
- You acknowledge that these terms are between you and us, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) — Apple has no further warranty obligation.
- You and Apple acknowledge that Apple is a third-party beneficiary of these terms and may enforce them against you.
12. Changes
We may update these terms. The new effective date will appear at the top of this page. Continued use after the update means you accept the revised terms. If you do not accept them, please stop using the Service.
